we all are permanent resident in canada.

Hello,

Thank you for sharing this situation with us.

We are sorry to hear about your brother-in-law’s father and his accident.

According to the Canada Revenue Agency (CRA) - Universal child care benefit, Canada child tax benefit Call Centre, yes it is possible to try and have you apply to transfer the CCTB to you. However, they suggested that if it will only really be a temporary period where the children will be with you, it may not be necessary. In fact, they suggest that it may be even more complicated because once she returns, she will have to re-apply.

They stated that although she is outside Canada and has temporarily transferred the care to you, she is still the primary caregiver with regards to having the power to make decisions related to the children.

We suggest that you may want to contact the Canada Revenue Agency (CRA) - Universal child care benefit, Canada child tax benefit Call Centre directly for additional information regarding this situation.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.
