My application to sponsor my spouse was refused in December 2015. In the appeal, I must prove that my marriage is genuine and “in good faith”.
Question 1: what documents do I use to prove so?
Question 2: once I have collected all the documents I need, how do I put them in a package? Put differently, how do I compile a bunch of documents/photos in an organized and logical manner?
Looking forward to all or any helpful advise. thanks in advance!
Hi,
So I submitted my appeal within the 30 days on Jan. 5th(ish) 2015. I still haven’t received any response from the IRB regarding the date of my appeal or any next steps. I also do have legal representation, but I do not have full faith in that representation (i.e. I am not satisfied with their “help”). I am trying to gather and organize things before any official date is set so that I am not scrambling last minute.
I would really appreciate it if I could get any sort of indication of how to organize the file (i.e. in what order should I have the documents complied) to present at the appeal.
You will receive the “blue book” from IAD about 4 months after the appeal is served on IRC. The blue book outlines IRC’s case and what you will have to address to prove that it is a valid marriage. Depending on your location, the appeal could take up to a full year for scheduling, if CIC refuses to participate in an ADR (Alternate Dispute Resolution).
If you don’t have confidence in your legal advisor, then you should probably find someone who you are more comfortable with. Your advisor should be outlining the steps that need to be taken.
